With regard to the alleged encroachment of the

Government land at Survey No.44 situated in Kattukaranai Village, Madhuranthagam Taluk, Chengalpattu District, by seven private individuals, already, a request had been made by the petitioner to the Revenue Authorities, that is the District Revenue Officer, the Revenue Divisional Officer and etc. concerned and pursuant to the said request made by the petitioner, already, action has been initiated by the Revenue Divisional Officer, Madhuranthakam, and he has sent a communication on 22.01.2024, stating the following:

Despite he has given directions to the second respondent

Tahsildar to complete the enquiry and to file a report, almost after two years' period, since the enquiry is yet to be completed at the hands of the Tahsildar concerned, the petitioner has approached this Court with the aforesaid prayer.

Heard Mr.M.Raja Sekhar , learned counsel for the petitioner and Ms.M.Jayanthy , learned Additional Government Pleader for the respondents.

Learned Additional Government Pleader, on instructions, would submit that, the enquiry is yet to be over and as long time has already been taken by the Tahsildar concerned, within the shortest time, to be stipulated by this Court, the enquiry would be completed and a report would be submitted to the Revenue Divisional Officer, who would take action and pass necessary orders to that effect, she contended.

Recording the said submissions made by the learned Additional Government Pleader, this Court is inclined to dispose of this writ petition with the following directions:-

(i) That there shall be a direction to the second respondent Tahsildar to complete the enquiry, as initiated by him pursuant to the letter dated 22.01.2024 in e/f/vz;/4324-2023-rp, within a period of one month from the date of receipt of a copy of this order and send a report to the Revenue Divisional Officer, Madhuranthakam, who in turn, after having considering the report, pass appropriate orders in accordance with law, within a period of two weeks thereafter.

With these directions, the writ petition is disposed of. However, there shall be no order as to costs. A copy of the present order shall also be communicated to the Revenue Divisional Officer, Madhuranthakam.
