This writ petitioner has been filed by the petitioner seeking to forbear the

respondents from initiating any actions by disposing the petitioner's land in

S.No. 208/2A and 208/2B, Mathigiri Village, without due process of law,

without passing the award and payment of compensation, based on the representation dated 12.03.2025.

2.Mr.P.Sathish , learned Additional Government Pleader, takes notice on

behalf of the respondents. By consent of the parties, the main writ petition is

¶29

taken up for disposal at the admission stage itself.

3.Learned counsel for the petitioner would submit that in the present case,

the petitioner's land in S.Nos.208/2A and 208/2B, Mathigiri Village, was acquired by the respondents/Highways Department. However, till date no award

has been passed and the respondents are attempting to take possession of the said land. Therefore, the petitioner apprehend that without paying the compensation, the respondents would take possession of the petitioner's land.

Hence, the present writ petition.

4.Learned Additional Government Pleader appearing for the respondents

after getting instructions would submit that the award will be passed with regard

to the subject property within a period of two weeks time, and thereafter, the

amount will be paid to the petitioner or the same will be deposited.

5.Heard the learned counsel for the petitioner as well as the learned

Additional Government Pleader appearing for the respondents and perused the

materials on record.

6.Taking note of the submissions made by either parties, it appears that

the award has not been passed by the respondents for the land acquired by the

¶45

them from the petitioner. According to the respondents they are under the process of awarding compensation and the same will be passed within a period

of two weeks. Further, the respondents will not take possession without the making the payment or depositing the same and therefore, the petitioner need

not apprehend.
