This Writ Petition has been filed seeking for a direction to the respondents to consider the petitioner's representation dated 15.11.2024 and dispose of petitioner online Application No. 2024/ 0105/ 08/ 536678 dated 4.09.2024 seeking transfer of patta in respect of the property situated at Thinnappatti Village, Mettur Taluk, Salem District bearing Survey No.499/2B1 Patta No. 1579 measuring 1 hectare 26 acres 50 cents (equivalent to 3.13 acres) and to effect the patta transfer in the petitioner name without any further delay.

2. The learned counsel for the petitioner would submit that the

petitioner purchased the aforesaid property from his vendors Mounthar and

Mahendran on 12.09.2022. Further, he would submit that the petitioner's vendors obtained patta for the entire extent of property by virtue of settlement deed executed by their father. After purchase of the aforesaid property, the petitioner made an online application seeking transfer of patta. As the same was not considered, the petitioner submitted a representation dated 15.11.2024 to the respondents requesting mutation of patta in his name. But the same has not been considered till date. Hence, this petition.

The learned Special Government Pleader appearing for the respondents 1 to 3 would submit that sisters of the petitioner's vendors filed O.S.No.327 of 2022 seeking to declare the sale deed executed between the petitioner and his vendor as null and void, on the ground that they are also entitled for the subject property and the said suit is pending. Therefore, patta could not be transferred in the name of the petitioner, till the disposal of the aforesaid suit. However, he would submit that the respondent concerned will issue patta in the name of the petitioner subject to the outcome of the aforesaid suit.
