Writ Petition is filed under Article 226 of the Constitution of India, pleased to issue Writ of Mandamus, directing the 2nd respondent to consider the petitioner association representation dated 23.03.2025 for conducting survey and passing an appropriate orders in view of the judgement of this honourable court made in W.P.No.16100 of 2007 vide order dated 29.07.2019 within a time bound manner and to pass.

Mrs. P. Vijayadevi, learned Government Advocate takes notice for the 1st

respondent. Mr. Abishek Murthy, learned Standing Counsel takes notice for the respondents 2 to 4. Mr. T. Chandrasekaran, learned counsel takes notice for the

5th respondent. As no adverse orders are passed against the respondents 6 to 22,

notice to the respondents 6 to 22 is dispensed with. With the consent of both the

¶45

learned counsels, the main writ petition is taken up for final disposal at the admission stage itself.

The above Writ petition is filed for issuance of a Writ of Mandamus,

¶49

directing the 2nd respondent, to consider the petitioner's representation dated

¶50

23.03.2025, and pass appropriate orders in view of the judgment of this Court in W.P.No.16100 of 2007 dated 29.07.2019, within the time frame fixed by this

¶51

Court.

The petitioner states that 5th respondent purchased large extents of land

¶53

for the purpose of forming layout of house sites. The layout was approved by

¶54

the planning authority and in the said approved layout, certain areas were

¶55

earmarked for public purposes like park, schools etc. The petitioner states that

¶56

5th respondent, by fabricating the original lay out approval submitted revised

¶57

approval plan and obtained revised approval for converting the reserved area

¶58

into housing plots. On the basis of the revised approval, the plots were sold to

¶59

the private respondents. Subsequently, the respondents 6 to 17 filed writ petition in W.P.No.16100 of 2007, which was disposed of with a direction to the

2 nd respondent, to conduct a detailed survey and pass order in accordance with

¶61

law. As the order of this Court in W.P.No.16100 of 2007, was not complied

¶62

with, the petitioner submitted a representation to take action as per the aforesaid

¶63

order of this Court. However, no action was taken, the petitioner therefore filed

¶66

the above writ petition for the aforesaid relief.

Heard both sides and perused the materials placed on record.

¶68

Having regard to the facts and circumstances of the case, and in view

¶69

of the limited prayer sought by the petitioner, this Court directs the 2nd respondent to consider the petitioner's representation dated 23.03.2025, in the light of the earlier direction issued by this Court in W.P.No.16100 of 2007 dated 29.07.2019, and to pass orders on merits and in accordance with law, within a period of eight (8) weeks from the date of receipt of a copy of this order. It is further made clear that the 2nd respondent while considering the petitioner's representation shall issue notice to the private respondents, and afford reasonable opportunity of hearing to the petitioner as well as private respondents.

Writ petition is accordingly disposed of. However, there shall be no order as to costs.
