This writ petition has been filed for the issuance of a writ of Mandamus directing the second respondent to deal with the representation made by the petitioner on 03.05.2025, wherein the petitioner is seeking for a lease deed to be executed in her favour by the temple and also to enable the petitioner to take physical possession of the property.

When the writ petition came up for hearing on 04.07.2025, this Court after going through the entire materials found that the petitioner had participated in the auction and was the highest bidder. In respect of the same, the lease deed was not executed in favour of the petitioner and some other person was also stopping the petitioner from entering into the property. Hence, this Court directed the learned Government Advocate to get instructions and accordingly the matter was listed for hearing today.

It is clear from the above that the petitioner has been granted lease of the subject property and an enquiry was conducted with one Pandian, who is said to have stopped the petitioner from entering the property. The said Pandian has given a statement that he has nothing to do with the property. In view of the same, the petitioner must be given some document to enable the petitioner to take possession of the property. The appropriate document in this case is a lease deed that has to be executed in favour of the petitioner.

In view of the above, there shall be a direction to the second respondent to execute the lease deed in favour of the petitioner in order to enable the petitioner to take possession of the property and utilise the same for agricultural
