This Writ Petition has been filed challenging the impugned order

passed by the fifth respondent dated 24.03.2023 made in Na.Ka.A/Puvi & Sura/413/2020 and the consequential lease deed registered as document No.2805 of 2023 dated 24.03.2023, on the file of the Sub Registrar Office, Marakanam in respect of the land comprising in Survey No.24/1, measuring to an extent of 1.63.0 hectare situated at Thalakaanikkuppam Village, Vanur Taluk, Villupuram District.

2. The petitioner is a resident of Thalakanikuppam Village, Vanur

Taluk, Villupuram District. S.No.24/1 measuring to an extent of 5 acres situated at Thalakanikuppam Village is a Government Tharisu land and the said land has been auctioned for the establishment of red soil quarry. The village people raised objections to the establishment of the said quarry. Hence, the petitioner along with the other village people made representation dated 05.10.2020 to the first respondent. Thereafter, a writ petition was filed before this Court in W.P.No.18054 of 2023 before this Court and the same was disposed of on 20.06.2023 with a direction to consider the petitioner’s representation dated 10.04.2023 and pass orders accordingly.

The petitioner in the present writ petition challenges the impugned

order passed by the fifth respondent dated 24.03.2023 and the consequential lease deed registered in favour of the seventh respondent with respect to the subject land.

Today, when the matter was taken up for hearing, the learned Special Government Pleader appearing on behalf of the respondents 1 to 5 submits that the subject land is a Government Tharisu land and the same has been auctioned for the establishment of red soil quarry and the Government order has been passed which was published in the Government Gazette also and thereafter, the subsequent auction was conducted on 29.10.2020 and one Vinoth, son of Chelladurai, was a successful bidder who was the seventh respondent in the present writ petition and the sanctioned order has been issued by the Deputy Director of Geology and Mining, Villupuram in favour of the seventh respondent for the period from 24.03.2023 to 23.03.2025. Based on the same, the Sub-Registrar, Marakkanam,/eighth respondent has registered the lease deed dated 14.07.2023.

respondents 1 to 5 further submits that since the lease deed is registered based on the sanctioned order passed by the Government, the same is valid. Hence, the writ petition has to be dismissed. He further submits that the said lease granted in favour of the seventh respondent has further been renewed on 09.10.2025 and therefore, the challenge made by the writ petitioner through this writ petition is infructuous.

Recording the submission made by the Special Government Pleader appearing for the respondents 1 to 5, this Writ Petition is dismissed with liberty to the petitioner to challenge the subsequent sanctioned order granted in favour of the seventh respondent in the manner known to law.
