ORDER

This writ petition has been filed for issue of writ of mandamus directing

the respondents 1 to 3 to consider the representation made by the petitioner on

12.12.2024 and to conduct enquiry as per Section 15 of the Registration of

Births and Deaths Act, 1969 and to remove the name of the father mentioned in

¶33

the Birth Certificate issued to the 6th respondent as "Charles".

2.Heard Mr.Hudson Samuel and Partners, learned counsel appearing on

behalf of the petitioner, Mr.E.Sundaram, learned Government Advocate

appearing on behalf of the 1st respondent and Mr.P.Srinivas, learned Standing

Counsel appearing on behalf of respondents 2 and 3.

3.The grievance of the petitioner is that the 6th respondent has managed

to show the name of Charles as the father and the specific case of the petitioner is that Charles is petitioner's husband and he has nothing to do with the paternity of the 6th respondent. To substantiate the same, the petitioner is

relying upon various documents. The petitioner gave a representation dated

12.12.2024 requesting to conduct an enquiry under Section 15 of the

Registration of Births and Deaths Act, 1969 and to remove the name of Charles

from the Birth Certificate. Since the same was not acted upon, the present writ

petition has been filed before this Court.

4.Taking into consideration the facts and circumstances of the case and

¶49

without going into the merits of the claim made by the petitioner, there shall be

¶50

a direction to the 2nd respondent to deal with the representation made by the petitioner on 12.12.2024, on its own merits and in accordance with law after affording opportunity to the 6th respondent and take a decision, within a period

¶51

of eight weeks from the date of receipt of copy of this order.

5.This writ petition is disposed of with the above directions. No Costs.
