The writ of mandamus has been instituted to direct the respondents and

related agencies to appoint a Three-Member Committee headed by a retired

¶81

High Court Judge, along with Experts in land and agriculture to determine the

¶82

market price, market value and open market value, provide employment for

¶83

suitable persons in the premises and ensure the development of the affected

¶84

local area (like road, schools, colleges, religious places, historical monuments

¶85

and pollution etc.,) and submits the report before this Court.

¶86

The very same writ petitioners have instituted W.P.No.19351 of 2022

¶87

challenging the notice issued Section 7(2) of the Tamil Nadu Acquisition of Land for Industrial Purposes Act, 1997 dated 24.01.2022. The present writ

¶88

petition has been filed seeking a direction to appoint a Three-Member Committee.

Section 7(2) of the Act enumerates that “Where the amount has been

¶93

determined by agreement between the Government and the person to whom

¶94

the amount has to be paid, it shall be paid in accordance in accordance with

¶95

such agreement” .

¶96

In the event of disagreement, then Section 7(3) of the Act would

¶97

operate and contemplates that “Where no such agreement can be reached,

¶98

the Government shall refer the case to the Collector for determination of the

¶99

amount to be paid for such acquisition as also the persons to whom such amount shall be paid” .

¶100

When the scheme under the Act contemplates procedures for

¶101

determination of compensation and the manner in which it is to be determined,

¶102

it is to be followed scrupulously by the competent authority. The High Court, in

¶103

exercise of powers of judicial review, cannot issue any direction contravening

¶104

the provisions of the Act, which would unsettle the procedures.

¶105

Thus, this Court is of the considered view that the relief sought for

¶106

falls beyond the realm of the powers of judicial review. Thus, the Writ Petition
