for issuance of a Writ of Mandamus, directing the 1^st and 2^nd respondents to consider the representation made by the Writ Petitioner on 26.03.2024 to the 1^st and 2^nd respondents and to take appropriate legal action against one M/s.Oriental Lotus Hospitality solutions Pvt. Ltd the company which illegally occupying our premises and carrying out illegal manufacturing of cosmetic without license.

This Writ Petition is filed by the petitioner seeking for a Writ of

Mandamus, to direct the respondents 1 and 2 to consider the representation made by the petitioner on 26.03.2024 and consequentially, to take action against the 3^rd respondent herein.

2. It is the case of the petitioner that during the year 2014, they

leased the premises to one M/s.Telefield (Hotel Supplies) Pvt. Ltd. for a period of three years. Later, the said M/s.Telefield (Hotel Supplies) Pvt. Ltd. changed its name as M/s.Oriental Lotus Hotel Supplies Pvt. Ltd. and the lease period was extended for a period of three years. Later, it was

renewed for a further period of five years.

2.1. It is the further case of the petitioner that during the month of

October, 2022, the said M/s.Oriental Lotus Hotel Supplies Pvt. Ltd. informed them that they have entered a business alliance with M/s.Oriental Lotus Hospitality Solutions Pvt. Ltd., the 3 rd respondent herein. It was pleaded before the petitioner that in order to get GST registration, a formal lease agreement was required. Believing the said request, they have entered into a lease agreement with the 3 rd respondent. According to the petitioner, there exists no lessor or lessee agreement between the parties and the petitioner entered into a lease agreement only with the bonafide belief and with a helping tendency so that the 3 rd respondent would get GST registration. However, the 3 rd respondent indulging in illegal activities by producing cosmetics without there being any license. Considering the danger that the 3 rd respondent poses for the society and also the petitioner, the petitioner gave a complaint to the respondents 1 and 2 to take action against the 3 rd respondents.

3. The respondents 1 and 2 have filed their counter affidavit. The

3rdrd respondent was impleaded on an application filed by them.

4. Heard the learned counsel appearing for the parties and also perused the materials available on record.

5. The respondents 1 and 2 has clearly stated that they had received an application submitted by the 3 rd respondent for the grant of cosmetics manufacturing license. However, the said request was rejected since the manufacturing license exists in the name of M/s.Telefield (Hotel Supplies) Pvt. Ltd. The counter affidavit further proceeds to states that indeed the show cause notice dated 05.08.2024 was issued by the licensing authority to the said M/s.Telefield (Hotel Supplies) Pvt. Ltd. to show cause as to why the license shall not be suspended. Since the original license stands only in the name of M/s.Telefield (Hotel Supplies) Pvt. Ltd., the 3 rd respondent is nowhere in the picture. Indeed, the representation of the petitioner has been considered by the respondents 1 and 2 by rejecting the application made by the 3 rd respondent herein. Therefore, no further order is necessary.

6. The Writ Petition is disposed of granting liberty to the

petitioner to take steps to evict the 3 rd respondent herein in the manner known to law. No costs.
