Petition filed under Article 226 of the Constitution of India to issue a Writ of Certiorari calling for the records relating to the common award passed by the first respondent made in C.P.Nos.175 to 182, 184 to 189, 191, 194, 197, 199, 200 to 213, 215 to 219, 222, 224 to 226 of 2011 dated 23.10.2013, quash the same.

The petitioner has filed this writ petition seeking issuance of Writ of Certiorari calling for the records relating to the common award passed by the first respondent made in C.P.Nos.175 to 182, 184 to 189, 191, 194, 197, 199, 200 to 213, 215 to 219, 222, 224 to 226 of 2011 dated 23.10.2013, quash the same.

2.The learned counsel appearing for the petitioner submitted that the private respondents filed computation petitions before the first respondent on the ground that they filed applications before the Inspector of Labour, Thiruvannamalai under Section 3(1) of the Tamil Nadu Industrial Establishment (Confirmation of Permanent Status to Workman) Act, 1981 and the Inspector of Labour passed order in their favour. Even thereafter, minimum wages were not paid to them. The learned counsel further submitted that subsequently, the order of the Inspector of Labour was challenged before this Court in W.P.Nos.153, 2341 & 6271 of 2014, 35849 of 2003, 19216 of 2005 and the same were allowed in favour of the petitioner. Hence, the impugned order passed by the first respondent is not sustainable one.

3.Since the order of the Inspector of Labour granting permanent status to the private respondents was challenged before this Court in W.P.Nos.153, 2341 & 6271 of 2014, 35849 of 2003, 19216 of 2005 and the same were allowed in favour of the petitioner, the order of the first respondent dated 23.10.2013 made in C.P.Nos.175 to 182, 184 to 189, 191, 194, 197, 199, 200 to 213, 215 to 219, 222, 224 to 226 of 2011, which was passed on the basis of the order of the Inspector of

Labour granting permanent status to the private respondents, is liable to be set aside and accordingly, the same is set aside.

4.The writ petition is allowed. No costs.
