This Writ Petition has been filed seeking for issuance of a Mandamus, to direct the respondents 3 & 4 to count the past services rendered by the petitioner in the National Institute of Technology, Trichirappalli as Lecturer and further grant promotions (i) to the post of Assistant Professor Stage I to II with effect from 12.04.2010, (ii) to the post of Assistant Professor Stage II to III with effect from 12.04.2015, (iii) to the post of Associate Professor Stage III to IV with effect from 12.04.2018 and (iv) to the post of Professor Stage IV to V with effect from 12.04.2021 with all consequential, monetary and other service benefits on the basis of the petitioner's representation dated 02.05.2023.

2.Heard the learned counsel for the petitioner and the learned Special Government Pleader appearing for the respondents and I have carefully perused the material available on record.

3.The case of the petitioner is that she has been appointed as Lecturer in the Department of Civil Engineering at National Institute of Technology by order issued by the Director of National Institute of Technology, Trichy dated 25.03.2006. She joined duty on 12.04.2006. She was awarded with Ph.D decree in Civil Engineering. In the year 2006 itself, she has applied for the post of Lecturer in the Pondicherry Engineering College. Thereafter, vide order dated 13.06.2007, the Pondicherry Engineering College, Puducherry issued an appointment order. Consequently, the petitioner submitted her resignation on 19.06.2007 to the Director, National Institute of Technology, Trichy. The petitioner reported to duty on 11.07.2007 in Civil Engineering Department of Pondicherry Engineering College, Puducherry. Thereafter, she was continuously working in the said College. As per the norms of the AICTE notification dated 08.11.2012, the past service of the petitioner in the National Institute of Technology, Trichy has

to be counted for promotion under the Career Advancement Scheme(CAS) and the petitioner is eligible for the next level of promotion i.e., Assistant Professor. In this regard, the petitioner has submitted a representation dated 02.05.2023 to the respondents 3 & 4. However, the same was not considered till date. Aggrieved by the same, the present Writ Petition has been filed.

4.During the course of hearing, Mr.R.Syed Mustafa, learned Special Government Pleader appearing for the respondents would submit that the representation of the petitioner dated 02.05.2023 will be considered in due course in accordance with law within time as stipulated by this Court.

5.In view of the above factual position and considering the submissions of the learned counsel on either side, in our considered view that it is appropriate and reasonable to dispose of this Writ Petition without going into the merits of the case, with a direction to the respondents 3 & 4 to consider the representation dated 02.05.2023 of the petitioner to meet the interest of justice.
