The petitioner has filed this writ petition seeking issuance of Writ of Certiorari calling for the records relating to the order dated 12.04.2024 in HRMD /SUP/TRF/329/2024 – 25 of the first respondent, quash the same.

2.The learned counsel appearing for the petitioner would submit that though the writ petition has been filed challenging the transfer order, after filing of the writ petition, the petitioner has submitted his letter of resignation and such resignation letter is still pending with the respondent.

3.The learned counsel appearing for the respondents would vehemently contend that the subsequent representation is not the subject matter of the writ petition. Hence prayed to dismiss the writ petition.

4.I have given my anxious consideration to either side submission.

5.When the writ petition has been filed challenging the transfer order on the ground of health reason, as rightly contended by the learned counsel for the respondents that the subsequent representation is not the subject matter, however, this Court deems it appropriate to issue direction to the respondents to consider the petitioner's resignation letter in accordance with the applicable Rules.

6.In such view of the matter, while dismissing the writ petition, this Court directs the respondents 1 to 3 to consider the petitioner's resignation letter in accordance with applicable Rules upon its own merits, as expeditiously as possible.

7.The writ petition is dismissed. No costs. Consequently, connected miscellaneous petitions are closed.
