O R D E R

This Writ Petition has been filed to direct the 1 st and 2 nd respondents

to further direct the 3 rd respondent to defreeze the petitioner's current bank account No.222126564677498 to the extent of Rs.26 lakhs.

According to the petitioner, he is engaged in the business of trading of two wheelers and allied financing services and maintaining a current account in A/c No.222126564677498 with the 3^rd respondent-Bank.

Based on the complaint lodged by one Mr.Rajan Babu against one K.S.Natrajan in the Cyber Police Portal, the petitioner's bank account was freezed, whereas, the amount of Rs.26 lakhs which is the basis for the freezing of petitioner's bank account is pertaining to a bonafide transaction and that the petitioner is no way connected with the alleged offence. Hence, he seeks to defreeze his bank account.

respondent police submitted that the petitioner is no way connected with the accused. Further, the FIR in Crime No.161 of 2023 which was registered based on the complaint lodged by one Mr.Rajan Babu, was subsequently quashed by this Court on the basis of compromise entered into between the parties vide Crl.O.P.No.20712 of 2023 dated 08.04.2023. 4.

Considering the fact that the very account of the petitioner was frozen on the basis of a complaint lodged by one Rajan Babu against one K.S.Natrajan and now the said FIR itself has been quashed, this Court is of the view that keeping the petitioner's bank account freezed on the basis of an earlier communication made in the Portal will serve no purpose.

Therefore, the 3^rd respondent-Bank is directed to defreeze the bank account of the petitioner forthwith.

6. With the above directions, this Writ Petition is disposed of. No costs.
