Writ on hand has been instituted to assail the order passed by the

Revenue Tahsildar in proceedings dated 16.11.2021.

The 3^rd respondent in the impugned order formed an opinion after

adjudication that the “Nilaviyal Paathai” can be used by the petitioner and there is no impediment for such usage. As far as the “Nilaviyal Paathai” in patta lands are concerned under RSO No.26(15), the Government has to protect the same as pathway to be utilised for common purpose by the public. The Tahsildar, after considering the issues made a finding that the petitioner and the public shall utilise the said pathway and there is no

impediment for the same.

Learned counsel for the petitioner would submit that “Nilaviyal Paathai” is to be relaid.

The question of relaying such “Nilaviyal Paathai” would not arise

at all, since “Nilaviyal Paathai” is maintained as a mud road and it is to be maintained as it is. The Government may not allocate funds for laying roads in respect of such pathway classified as “Nilaviyal Paathai” situated in patta

lands and therefore, such claim set out by the petitioner is unacceptable. Therefore, this Court does not find any infirmity in respect of the order impugned in the writ petition. Consequently, the Writ Petition stands dismissed. No costs.
