This petition has been filed by the petitioner to quash the circular

issued by the third respondent in the impugned order

No.TCL/0287/Per/Policy dated 24.11.2021.

The learned Government Advocate appearing for the Respondents 1 & 2 would submit that the circular issued by the 3^rd respondent has been

kept in abeyance since 28.09.2022, and therefore the writ petition can be closed for the present.

The learned counsel appearing for the petitioner would submit that

the circular was not withdrawn by the third respondent and the same is kept

in abeyance, therefore, it can be implemented at any time, and therefore he strongly objected.

Considering the above said submissions, this Court is of the view that since the impugned order has been kept in abeyance since 28.09.2022 and has not yet been implemented, the 3^rd respondent is at liberty to issue a fresh circular, if they want to implement it. At the same time, the petitioner is also at liberty to challenge the fresh circular if any, issued by them, if they are aggrieved by it.
