PRAYER: The Writ Miscellaneous Petition is filed to extend the time for a further period of three months to complete the investigation and to file final report before the Court concerned as per the direction given by this Court in WP No.33520 of 2022 and WMP No.32969 of 2022 dated 24.01.2023.

This Court by order dated 24.01.2023 had allowed the writ petition directing transfer of investigation to CBCID and the investigation be conducted by a police officer in the rank of Deputy Superintendent of Police. This Court had further directed that the investigation shall be completed within a period of three months. Therefore, the petitioner has filed this Writ Miscellaneous Petition seeking for extension of time.

filed a final report closing the case as 'mistake of fact'. Hence, nothing survives for adjudication in the petition seeking extension of time.

At this juncture, the learned counsel for the 1^st respondent would submit that the 1^st respondent has filed a protest petition in Crl.M.P.No.1669 of 2024 before the learned Magistrate and the same is pending adjudication and sought for a direction to the learned Magistrate to dispose of the same as expeditiously as possible.

Considering the request made by the learned counsel, the learned Judicial Magistrate No.I, Jayankondam is directed to dispose of the protest petition i.e., Crl.M.P.No.1669 of 2024 on merits and in accordance with law, as expeditiously as possible.
