Upon perusing the documents and case records of the above CC.600037/2012 on the file of the Judicial Magistrate Court No I, Ramanathapuram Ramanathapuram Taluk, Ramanathapuram transmitted to this Court and hearing the arguments of Mr.S.Ravi, learned Additional Public Prosecutor, assisted by Mr.M.Sakthi Kumar Advocate, (Crl.Side) on behalf of the State, this Court passes the following

This dedicated bench is for implementing the pilot project to identify and dispose of criminal cases involving offences punishable with imprisonment up to 3 years pending at trial, appeal or revision stage for more than 3 years and also offences like Section 506(ii) of IPC and others, which may carry a punishment of more than 3 years in the State of Tamil Nadu with reference to the 14 Districts coming under the Madurai Bench of Madras High Court.

This Dedicated Bench has taken the CC.600037/2012 on the file of the

Judicial Magistrate Court No I, Ramanathapuram, Ramanathapuram Taluk, Ramanathapuram as SUO MOTU TR(MD).No. 16190 of 2025 in Suo Motu W.P. (Crl.).(MD).No.1014 of 2025, upon proper scrutinity and considering its suitability that it is a fit case warranting the exercise of power under 482 of Cr.P.C. to quash the said case, which is pending for a long time without any progress.

The allegation in this case is that the accused persons unlawfully assembled and obstructed a Government officer from discharging his official duties and hence, a case was registered in Crime No. 146/2010 for the offences under Sections 147, 148, 294(b), 353, 355 and 506(ii) of IPC and Section 149 of IPC . Final report was filed and the same was taken on file in CC.600037/2012 and the same is pending without trial for a long time. Mr. S.Ravi, learned Additional Public Prosecutor, also submitted that there are no previous antecedents against the accused.

Upon perusal of the records, this court finds that there is no

incriminating material to frame the charges against the accused. Further, final report does not disclose sufficient material to constitute any offence under the

said Sections. Further, this case is pending without trial for a long time and continuation of the trial by examining the witnesses would lead to wastage of time and wastage of Government exchequer and also lead to docket explosion without adjudication and the chance of conviction even after the full-fledged trial would also bleak. Hence, this Court is inclined to quash the proceedings by exercising power under Section 482 Cr.P.C.

This Court suo motu called for the records and exercised its power under Section 482 Cr.P.C. and quash the same and hence this verdict does not confer any right to any of the accused or any party to file a case against the Investigating Agency for the malicious prosecution or claim damages.
