PRAYER: Second Appeal is filed under Section 100 of Civil Procedure Code, to call for the records from the Courts below and set aside the Decree and Judgment in A.S.No.52 of 2008 passed by the Learned District Judge, Kanyakumari at Nagercoil, dated 18.10.2011 confirming the Decree and judgment in O.S.No.24 of 2004 on the file of the Learned Subordinate Judge, Kuzhithurai, dated 14.08.2008 by allowing this Second Appeal.

JUDGEMENT
When the matter is taken up for hearing, there is no appearance on either side. In order to implead the Legal Heirs of the sole Appellant this Court has already granted time. Since no steps was taken this case was posted today i.e., on 09.01.2025 for dismissal. Today also there is no representation on either side.
2. Therefore, this Second Appeal is dismissed for non prosecution. No Costs. Consequently, connected miscellaneous petitions are closed.
