No.160 of 2021 in W.P.No.24161 of 2018 and W.P.No.6371 of 2021 - Review of the Division Bench order dated 20.09.2021 upholding G.O.Ms.No.24 dated 03.07.2018 of the Government of Puducherry fixing a separate annual fee of Rs.16 lakhs for Management Quota MBBS seats (AY 2017-18) in three private medical colleges, and allied writ petition seeking quashing of the G.O. and refund of excess fees, claiming the common Fee Order dated 19.05.2017 (valid 3 years) should govern - Review Applicant urged errors apparent on the face of the 112-page order, exclusion of student/parent stakeholders from the Fee Committee, Article 14 arbitrariness in uniform fee across three colleges, and mistakes of law citing U.N. Singh, Narayana Medical College, Pramati Educational Trust, P.A. Inamdar, Islamic Academy, Modern Dental College and Director of Settlements - Colleges countered that the Government had directed separate Management Quota fee per Pramati, that prior to 19.07.2017 no Management/NRI quota fee was ever fixed in Puducherry, that the Association (registered 10.09.2018) could not seek the 2017 fee, and that students had accepted the fee as tentative in writing - Held: the previous Fee Fixation Committee had no occasion to fix Management Quota fee, fixation being restricted to Government Quota seats; the 2018-registered Association cannot seek the 2017 fee; students who reconciled to the tentative fee in writing cannot re-agitate under the garb of Review - All points rejected as meritless; Review Petition and Writ Petition dismissed, no costs; connected miscellaneous petitions closed.
