Ground: the Detaining Authority's inference that the detenu might be released on bail was based on a bail order in Crl.O.P.No.30749 of 2024, where bail was granted as the murder was under sudden provocation, unlike the planned murder in the ground case — hence not a similar case, showing non-application of mind. Following Rekha v. State of Tamil Nadu, 2011 [5] SCC 244 (ipse dixit on imminent possibility of bail cannot sustain detention), the detention order was set aside and the detenu ordered released unless required in any other case.
