Relying on Sushanta Kumar Banik Vs. State of Tripura (2022 LiveLaw (SC) 813), Gomathi Vs. Principal Secretary to Government (2023 SCC OnLine Mad 6332) and Nagaraj Vs. State of Tamil Nadu ((2018) 3 MWN (Cri) 428), the Court held that the unexplained and inordinate delay between arrest and detention order snaps the live and proximate link between the grounds and purpose of detention; the detention order dated 30.04.2025 was set aside and the detenu directed to be set at liberty forthwith unless required in any other case.
