The revision petition is at that instance of the defendants, challenging the

leave granted to the plaintiff to receive additional documents.

2.Heard Mr.M.Guruprasad, learned counsel for the petitioner and

Mr.c.Arunkumar, learned counsel for the respondents to 3.

3.The trial court allowed the application, permitting the documents to be

¶36

received as additional documents under Order VII Rule 14 of the CPC.

¶37

4.Mr.M.Guruprasad, learned counsel for the petitioner, invited my

¶38

attention to the documents that are sought to be now introduced. Most of the documents are photographs, and admittedly there are no negatives, enclosed

¶39

along with the photographs; therefore, the said photographs are inadmissible in

¶40

evidence. He also particularly points out to the fact that the photographs are

¶41

around the year 1989 and are all much prior to the digitalisation of cameras, and

¶42

therefore, unless the negatives are accompanying the photographs, the

¶43

photographs are inadmissible.

5.Be that as it may, considering that the trial court has only permitted the

¶47

receipt of the documents, the stage for objecting to the admissibility of the documents has not arisen, and therefore, it is always open to the revision petitioner to object to the marking of the documents.

6.The trial court shall permit the documents that are now received

¶49

pursuant to I.A.No.110/2024 to be marked only subject to them being admissible in evidence and not otherwise.

7.The Civil Revision Petition is dismissed with the above observations.

There shall be no order as to costs. Consequently, the connected miscellaneous

¶52

petition is also closed.
