Challenging the order passed by the learned Judicial Magistrate No.I, Kovilpatti in Crl.M.P.No.8037 of 2023 in Crime No.85 of 2023 on 06.07.2023 cancelling the anticipatory bail granted by this Court in Crl.O.P(MD)No.6252 of 2023, dated 03.04.2023 for the reason of breaching the conditions imposed by this Court in the aforesaid order, this criminal revision case is filed.

The learned counsel for the petitioner submitted that the

condition imposed by this Court while allowing the application for anticipatory bail was to appear before the Karur Police Station daily at 10.30 a.m., and 05.30 p.m., for a period of four weeks and thereafter, report before the respondent police daily at 10.30 a.m., for a period of two weeks. However, the said condition was not complied by the petitioner. The learned counsel for the petitioner submitted that there are as many as four police stations, namely Karur Police Station, All Women Police Station, Prohibition Enforcement Wing, Vengamedu Police Station. Eventhough the petitioner had appeared before all those police

stations, the Officers in charge of the said police stations informed that no intimation in this regard has been received from this Court. Only under such situation, he was not able to comply.

The learned Government Advocate submitted that the

submission of the learned counsel for the petitioner is evasive and the order of this Court was quite clear that the petitioner should comply the condition by appearing before the Karur Police station, which would precisely mean Karur Town Police Station. Had the petitioner appeared before the Karur Town Police Station with the copy of the order, they would have facilitated him to comply with the order. Having not done so, now he is not justified in filing this criminal revision case challenging the order of the learned Judicial Magistrate No.I, Kovilpatti cancelling the order passed by this Court in compliance to the order passed by this Court in Crl.O.P(MD)No.6252 of 2023 and pressed for dismissal of the revision case.

Considering the fact that the petitioner is inclined to comply

with the condition without default, this Court warning the petitioner not to take the order passed by this Court lightly and this Court is of the considered view that a heavy cost should be imposed on him for his inadvertence. Hence, this Court imposing a cost of Rs.25,000/- (Rupees Twenty Five Thousand only) for not complying with the conditions of this Court passed in Crl.O.P(MD)No.6252 of 2023 for the past 2 years, further directs the petitioner to deposit Rs.25,000/- (Rupees Twenty Five Thousand only) to the credit of the RAY OF LIGHT FOUNDATION, Bank Name: HDFC BANK, A/c No:50100078904233, A/c Name: Ray of Light Foundation, Branch: HABIBULLAH ROAD, T NAGAR, CHENNAI, IFSC code: HDFC0001864 and comply with the order of the learned Judicial Magistrate No.I, Kovilpatti in Crl.M.P.No.4680 of 2023, dated 04.08.2023 strictly from 01.07.2025 by appearing before the Karur Town Police Station. In case of any deviation, this order will be automatically vacated and the order passed by the learned Judicial Magistrate No.I, Kovilpatti in Crl.M.P.No.8037 of 2023, dated 20.06.2023 would be given force.
