The petitioner has sought for transfer of investigation mainly alleging

that though the F.I.R was registered in the year 2023, the respondents have not file final report, even now.

Per contra, the learned Additional Public Prosecutor, on instructions,

would submit that the final report could not be filed, since two accused were

absconding and that the respondents would take effective steps to secure the accused and file final report. He would further submit that the investigation

in all other aspects are completed and they will file final report within two months.

In such circumstances, the learned counsel for the petitioner would submit that he is not pressing for the transfer of the case.

Recording the aforesaid submission, this Criminal Original Petition is disposed of with a direction to the sixth respondent to complete the investigation and file a final report within a period of two months from today.
