PRAYER :- For Bail in Crime No.52 of 2017 on the file of the respondent police, now pending at the learned V Additional and Sessions Court, Madurai in S.C.No.511 of 2017.

ORDER : The Court made the following order :-

The petitioner, who was arrested and remanded to judicial custody on 28.11.2024 for the offences punishable under Sections in Crime No. 52 of 2017 on the file of the respondent police, seeks bail.

The case of the prosecution is that due to wordy quarrel the petitioner along with other accused persons attacked the deceased with a knife and caused multiple injuries. Hence, the complaint.

The learned Counsel for the petitioner submitted that the petitioner is an innocent person and he has not committed any offences as alleged by the prosecution and the petitioner is in judicial custody from 28.11.2024

The learned Additional Public Prosecutor submitted that the

petitioner has five previous cases, out of which two cases are under Section 302 of IPC.

Taking into consideration the facts and circumstances of the case and also considering the period of incarceration suffered by the petitioner, this Court has already granted interim bail to the petitioner and the same is hereby confirmed, subject to the following conditions:

[a] the petitioner shall report before the Trial Court daily at 10.30 a.m., until further orders.

[b] the petitioner shall not abscond either during investigation or trial.

¶29

[c] the petitioner shall not tamper with evidence or witness either during investigation or trial.

[d] On breach of any of the aforesaid conditions, the learned Magistrate/Trial Court is entitled to take appropriate action against the petitioner in accordance with law as if the conditions have been imposed and the petitioner released on
