This criminal original petition has been filed to quash C.C.No.301 of 2017 on the file of Judicial Magistrate Court, No.I, Tiruppur.

2.When the matter was taken up for hearing today, the learned Additional Public Prosecutor submitted that the case pertains to the year 2017. The petitioner had earlier filed a quash petition in Crl.O.P.No.12568 of 2017 and this Court, after hearing the parties and finding that there were materials against the petitioner, dismissed the quash petition by order dated 09.12.2021. Thereafter, the petitioner also filed a discharge petition in C.M.P.No.8192 of 2022 in C.C.No.301 of 2017, which came to be dismissed on 01.12.2022. Aggrieved by the same, the petitioner filed a revision in Crl.R.C.No.158 of 2023 before this Court and the revision was also dismissed. He further submitted that the petitioner is prolonging the litigation.

3.Heard the learned counsel appearing for the petitioner as well as the learned Additional Public Prosecutor appearing for the first respondent and the learned counsel appearing for the second respondent.

4.Perused the materials available on record. This Court finds that the petitioner had earlier filed a Crl.O.P.No.12568 of 2017, which was dismissed by order dated 09.12.2021. Subsequently, the discharge petition filed by the

petitioner was also dismissed and the revision preferred in Crl.R.C.No.158 of 2023 was also dismissed. This Court finds that the present petition has been

filed only to delay the genuine prosecution pending before the concerned Court.

5.In view of the above, this Court is not inclined to interfere with the proceedings of the trial Court. Accordingly, this criminal original petition is dismissed. Consequently, connected miscellaneous petitions are closed.
