The petitioner was arrested on 18.09.2024, on execution of Non Bailable

Warrant issued by the learned Additional District Judge, Hosur, Krishnagiri District, for the offence punishable under Sections 392, 302, 201 read with 34 IPC pending trial in S.C.No.116 of 2024 in respect of Crime No.50 of 2017 on

the file of the respondent police, seeks bail.

2.The petitioner herein earlier arrested and granted bail. After the case

was posted for committal to the Court of Sessions in S.C.No.116 of 2024, summons were issued to the petitioner on 27.06.2019, which was duly served on him by the respondent police. Since he was in prison, the Trial Court issued a P.T warrant against the petitioner on 13.09.2019, and he was produced before the Trial Court on 27.09.2019. Subsequently, though the petitioner was released on bail in other cases, he defaulted in appearance before the Trial Court. Hence, Non-Bailable Warrant (NBW) was issued. Thereafter, the petitioner was arrested and remanded to judicial custody on 18.09.2024. He also submitted that the petitioner would undertake that hereafter he would regularly appear before the Court on all hearing dates and also stated that he has prepared to comply with any stringent conditions that may be imposed by this Court. Therefore, he prays for grant of bail to the petitioner.

Learned Government Advocate (Crl.Side) appearing for the respondent submitted that since the petitioner, who is A1 facing trial in S.C.No.116 of 2024 on the file of the learned Additional District Judge, Hosur, Krishnagiri District, has failed to appear before the trial Court and therefore, the trial Court has issued PT warrant against the petitioner on 13.09.2019, and pursuant to which NBW issued against the petitioner, he was arrested and remanded to judicial custody on 18.09.2024. Hence, he oppose for grant of bail to the petitioner.

Heard the learned counsel for the petitioner and the learned Government Advocate (Crl.Side) and perused the materials available on record.

Considering the fact that bail was already granted to the petitioner and thereafter NBW was issued and immediately, the same has been executed and considering the fact that after completion of investigation, final report has also been filed and now the case is posted for examining the witnesses and also considering all other factors, this Court is inclined to grant bail to the petitioner subject to the following conditions:

Accordingly, the petitioner is ordered to be released on bail on his executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) each, with two sureties, each for a like sum to the satisfaction of the learned Additional District Judge, Hosur, Krishnagiri District and on further conditions that :-

[a] the petitioner shall report before the Trial Court on every working day at 10.30 a.m., until further orders, without fail.

[b] the petitioner shall not commit any offences of similar nature.

¶31

[c] the petitioner shall not abscond either during investigation or trial.

¶32

[d] the petitioner shall not tamper with evidence or witness either during

investigation or trial.

[e] On breach of any of the aforesaid conditions, the learned Judicial Magistrate/Trial Court is entitled to take appropriate action against the petitioner in accordance with law as if the conditions have been imposed and the petitioner released on bail by the learned Magistrate/Trial Court himself as laid down by the Hon'ble Supreme Court in P.K.Shaji vs. State of Kerala [(2005)AIR SCW 5560].

[f] If the accused thereafter absconds, a fresh FIR can be registered under Section 269 BNS.
