The petitioners, who were arrested and remanded to judicial custody

on 14.09.2025 for the alleged offence under Section 8(c), 20(b)(ii)(B), 29(1)

of the Narcotic Drugs & Psychotropic Substances Act, 1985, in Crime No. 850 of 2025 on the file of the respondent police, seek bail.

2. The case of the prosecution is that the petitioners along with other

accused was found to be in illegal possession of 2 kgs of Ganja. Hence, the case.

¶20

3 . The learned counsel appearing for the petitioners submitted that the petitioners are innocent persons and they have been falsely implicated in this case. He also submitted that the petitioners are in Judicial Custody from 14.09.2025 and they are ready to abide by any stringent conditions that may

be imposed by this Court. Hence, he prayed for grant of bail to the petitioners.

4 . In response, learned Government Advocate (Crl. Side) opposes the

petition on the ground that, petitioners were found in illegal possession of 2 kgs of ganja.

5. Heard both sides and perused the materials available on record.

¶25

6 . Taking into consideration, the fact that the petitioners are in Judicial Custody from 14.09.2025 and that, substantial part of the

investigation have been over by this time, no previous case reported against

¶29

the petitioners, this Court is inclined to grant bail to the petitioners.

7. Accordingly, the petitioners are ordered to be released on bail on their executing a bond for a sum of Rs.20,000/- (Rupees Twenty Thousand only) with two sureties , for a like sum to the satisfaction of the learned

Additional District Judge / Presiding Officer Special Court for Essential

Commodities Act Cases, Coimbatore and on further conditions that:

[a] the sureties shall affix their p hotographs and Left Thumb Impression in the Application for Surety ship [Judicial Form No.46 annexed to 'The Criminal Rules of Practice, 2019']. The learned Magistrate shall obtain a copy of any one of the identity proofs to ensure their identity;

¶34

[b] the petitioners shall report before the respondent police daily at 10.30 a.m., for a period of three weeks and thereafter as and when required for interrogation;

[c] On breach of any of the aforementioned conditions, the learned Magistrate/Trial Court is entitled to pass appropriate orders against the petitioners in accordance with law as if the aforementioned conditions have been imposed and the petitioners released on bail by

the learned Magistrate/Trial Court himself as laid down by the Hon'ble Supreme Court in P.K.Shaji vs. State of Kerala [ (2005)13 SCC 283 ];

[d] If the accused thereafter absconds, a fresh FIR can be registered under Section 269 of B.N.S.
