The petitioner, who was arrested and remanded to judicial custody on 10.07.2025 for the alleged offence punishable under Sections 8(c) r/w 20(b)(ii(c) and 25 of NDPS Act, 1985 and Section 286 of BNS r/w Section 24(1) of COTPA Act and Section 59 of Food Safety Act in Crime No.326 of 2025 on the file of the respondent police, seeks bail.

The allegation against the petitioner is that the petitioner was found in possession of 61.600 kilograms of Ganja Chocolates in Charminar named 308 packs each contains 200 grams, 11.400 kilograms of Gokul Munakka Vati named Ganja Chocolates in 57 packs each contains 200 grams and Tobacco-145 packets in the name of VI Tobacco, 190 packets in the name of Vimal, and 20 packets in the name of Swagath. Based on the complaint, the petitioner was arrested on 10.07.2025.

The learned Counsel for the petitioner submits that the petitioner was arrested and remanded to judicial custody from 10.07.2025 and he is not having any previous case. However, the petitioner is ready to abide by any condition imposed by this Court. He prayed to grant bail to the petitioner.

4. The learned Government Advocate (criminal side) appearing for the

respondent police reiterated the prosecution case and submits that this case is of commercial quantity, and Section 37 of the NDPS Act, is applicable to the case of the petitioner herein and investigation is pending. Apart from that the petitioner is having six previous case similar in nature. He opposed for grant of bail to the petitioner.

5.Considering the fact that it is a case of commercial quantity and also the petitioner is not only involved in transportation of huge quantity of Ganja and he has also collected banned tobacco products and other intoxicated contraband. Hence, under Section 37 of the NDPS Act is also applicable. He further submits that the investigation is pending and so far no recovery was made, this Court is not inclined to grant bail to the petitioner.

6. Accordingly, this Criminal Original Petition is dismissed.
