& 351(2) of BNS r/w Section 4 of Tamil Nadu Prohibition of Harassment of Women Act, 2002 in Crime No.144 of 2025, on the file of the respondent Police, seek anticipatory bail.

The case of the prosecution is that the defacto complainant and the

petitioner became acquainted during their B.A.LL.B (Hons.) course at M.G.R. University, in the year 2021, and subsequently developed a relationship. It is alleged that the petitioner promised to marry the defacto complainant. On 21.06.2025, at about 1.30 p.m., both travelled by car to Kannamapettai burial ground area, where the petitioner, who was allegedly under the influence of alcohol, received a phone call. When the defacto complainant enquired about the caller, a quarrel ensued. It is further alleged that the petitioner stated that he was engaged to another women and was no longer willing to marry the defacto complainant. On hearing this, the defacto complainant questioned him, and the petitioner allegedly abused her using vulgar language, cast aspersions on her character, and thereafter physically assaulted her by holding her hand and attempting to hit her. The defacto complainant then got down from the vehicle and confronted the petitioner, whereupon he pushed her and left the place in this car. The defacto complainant later went to K.K.Nagar Government Hospital for treatment.

Hence, the present case.

Heard the learned counsel appearing for the parties.

It is submitted by both parties that the matter was earlier referred to

Mediation by order dated 08.09.2025. The report of the Mediator has now filed, indicating that the parties have amicably settled the dispute and the defacto complainant has no objection. Hence, this Court is inclined to grant anticipatory bail to the petitioner with certain conditions.

5. Accordingly, the petitioner is ordered to be released on bail in the event of arrest or on his appearance, within a period of fifteen (15) days from the date on which the order copy made ready, before the learned XIII Metropolitan Magistrate Court, Saidapet, Chennai-15, on condition that

the petitioner shall execute a bond for a sum of Rs.10,000/- (Rupees Ten

Thousand only), with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned, and on further conditions:

[a] if the petitioner fails to surrender before the concerned Magistrate within a period of fifteen days

from the date of receipt of a copy of this order, this order shall stand automatically cancelled;

¶31

[b] the sureties shall affix his photographs and Left Thumb Impression in the Application for Surety ship [Judicial Form No.46 annexed to 'The Criminal Rules of Practice, 2019']. The learned Magistrate shall obtain a copy of any one of the identity proofs to ensure their identity;

[c] the petitioner shall report before the respondent police daily at 10.30.a.m., for a period of two weeks and thereafter as and when required for interrogation;

[d] On breach of any of the aforementioned conditions, the learned Magistrate/Trial Court is entitled to pass appropriate orders against the petitioner in accordance with law as if the aforementioned conditions have been imposed and the petitioner released on bail by the learned Magistrate/Trial Court himself as laid down by the Hon'ble Supreme Court in P.K.Shaji vs. State of Kerala [ (2005)13 SCC 283 ];

[e] If the accused thereafter absconds, a fresh FIR can be registered under Section 269 of B.N.S.
