PRAYER: Criminal Original Petition is filed under Section 482 of Cr.P.C/ Section 528 of Bharatiya Nagarik Suraksha Sanhita, 2023, to modify the condition (ii) that the petitioner shall produce fixed deposit of Rs.20,41,671/(Rupees Twenty Lakhs Forty One Thousand and Six Hundred and Seventy One) in the name of Special Judge, Special Court TNPID Act, Chennai to this Court to the credit of CC No.9/2023 in Cr.No.7/2022 on the file of EOW-II, Chennai, Reg.No.TN21 BL 0600, imposed by the Hon'ble Special Court under TNPID Act Court in Crl.M.P.No.1252/2024 in CC No.9/2023 dated 24.05.2024.

This petition has been filed to modify the condition imposed by the

Special Judge, Special Court under TNPID Act, Chennai in Crl.M.P.No.1252 of 2024 in CC No.9 of 2023 dated 24.05.2024.

Heard the learned counsel on either side and perused the materials

placed on record.

The case of the prosecution is that while releasing the petitioner's vehicle bearing Registration No.TN 21 BL 0600, Toyota Vellfire Hybrid, the Special Court under TNPID Act, Chennai in Crl.M.P.No.1252 of 2024 by an order dated 24.05.2024 i mposed a condition that the petitioner shall produce fixed deposit of Rs.20,41,671/- (Rupees Twenty Lakhs Forty One Thousand and Six Hundred and Seventy One) in the name of Special Judge, Special Court TNPID Act, Chennai to the credit of CC No.9 of 2023 in Cr.No.7 of 2022 on the file of EOW-II, Chennai. However, the petitioner is unable to comply with the said condition. Hence, the petitioner seeks modification of the above said condition.
