These Criminal Miscellaneous Petitions have been filed (i) to suspend the sentence of imprisonment imposed on the petitioner/sole accused by the learned Judicial Magistrate No.1, Kumbakonam, in C.C.No.23 of 2022, dated 02.09.2022, which was confirmed by the learned Additional District and Sessions Judge (Fast Track Court), Kumbakonam, in Crl.A.No.75 of 2022, vide judgment dated 31.01.2025, pending disposal of the criminal revision and (ii) to exempt the petitioner to surrender before the trial Court.

to their house, the petitioner, who came there in his two wheeler, went close to the said Chandra and robbed gold chain weighing around 4 sovereigns, which she was wearing and when he tried to flee from the spot, the said Chandra caught hold of him and on the basis of the complaint given by the defacto complainant, FIR came to be registered in Crime No.1273 of 2021.

of 2025 is ordered. Accordingly, the relief of suspension of sentence and bail is granted to the petitioner on the following conditions:-
(i) The petitioner shall execute a bond for a sum of Rs.25,000/(Rupees Twenty Five Thousand only) with two sureties, each for a like sum to the satisfaction of the Judicial Magistrate No.1, Kumbakonam;
(ii) The sureties shall affix their photographs and Left Thumb Impression in the surety bond and the trial Court may obtain a copy of their Aadhar card or Bank Pass Book to ensure their identity; and
(iii) The petitioner shall appear before the trial Court once in a month i.e., on the first working day of every English calendar month at 10.30 a.m., until further orders and if he is not able to appear before the trial Court on any day, he shall make arrangements to file an application under Section 355 B.N.S.S. and shall appear before the trial Court on any other day in lieu of the date of his absence, as directed by the trial Court.
