This Contempt Petition has been filed to punish the contemnor/

third respondent for his willful disobedience of the order of this Court passed in W.P(MD) No.4076 of 2023 dated 28.02.2023

The learned Additional Advocate General would submit that in

order to comply with the order of this Court notice under Section 7 of the Land Encroachment Act was issued by the first respondent and challenging the same the aggrieved parties approached the District Collector by way of appeal since appeal remedy is available to the parties.

It is seen from the records that the appeal was kept pending for

more than two years. The reasons stated in the affidavit is not

acceptable. However pending this petition after receiving notice the second respondent had disposed the appeal on merits on 20.11.2025. Subsequent to the disposal of the appeal notice under Section 6 of the Land Encroachment Act was also issued to the parties.

In view of the same, the Contempt Petition stands closed. However the respondents are directed to comply with the orders of this Court within a reasonable time, provided to complete the process within a period of three months. Consequently connected sub application stands closed.
