This Contempt Petition has been filed to initiate contempt proceedings against the respondents, for disobeying the order dated 06.01.2021, passed in I.A.No.2 of 2019 in O.S.No.75 of 2019, on the file of the learned District Munsif-cum-Judicial Magistrate No.1, Hosur.

Heard both sides and perused the materials available on record.

It appears that the order in I.A.No.2 of 2019 in O.S.No.75 of 2019, on the file

of the learned District Munsif-cum-Judicial Magistrate No.1, Hosur, has been passed in the year 2021 i.e. on 06.01.2021 and the suit in O.S.No.75 of 2019, is pending from the year 2019. Therefore, if there is any violation in the order of interim injunction, there is an enabling provision under Order 39 Rule 2-A of CPC and the aggrieved party can file a contempt petition before the Court which passed the said order. Since the said suit is pending from the year 2019 and if violation still continues, the petitioner is at liberty to approach the trial Court.
