PRAYER : Civil Suit (Commercial Division) filed under Order IV Rule 1 of O.S.Rules Read With Order VII Rule 1 of Civil Procedure And Section 2(1)(c)(xvii) Read With Section 7 of the Commercial Courts Act, 2015 and Sections 55 and 62 of the Copyright Act, 1957, praying to grant a judgment and decree on the following terms:-

(a) Declaring that the Plaintiff is the rightful owner of the copyrights including but not limited to the right to dub, exploit and exhibit the Suit Film 'Mersal' in all local / regional languages in territories all over the world except India, which includes all foreign dialects of languages of Indian origin, as spoken in such foreign countries, and the Internet / Digital copyrights in the Suit Film assigned in its favour under the Agreement dated 04.08.2016 and Addendum Agreement dated 11.10.2017;

(b) Granting a Permanent Injunction restraining the 1^st & 2^nd Defendants, their men, agents, employees, servants, licensees or persons claiming through or under them, from in any manner interfering with the exploitation of the copyrights in the Suit Film 'Mersal' by the Plaintiff or its licensees;

JUDGMENT

Learned counsel for the plaintiff submits that all disputes between the parties were settled and that the compromise was recorded in a civil suit before the Commercial Division of the Bombay High Court. Therefore, he submits that he has been instructed to withdraw the suit. An endorsement has been made for such purpose.
