This civil miscellaneous petition is filed to permit the petitioners to withdraw 50% of the award amount along with proportionate accrued interest and costs, deposited by the 1st respondent/appellant to the credit of MCOP No.6 of 2022 on the file of the Motor Accidents Claims Tribunal/Subordinate Judge, Melur.
3.The appellant Insurance Company filed the main appeal challenging the negligence as well as the quantum. This Court, by order, dated 05/08/2025, has granted conditional stay. As per the order of this Court, dated 05/08/2025, the Insurance Company has deposited the entire award amount along with proportionate accrued interest and costs to the credit of MCOP No.6 of 2022 on the file of the Motor Accident Claims Tribunal/Sub Court, Melur.

4.Considering the above facts and circumstances of the case, this
civil miscellaneous petition is allowed and the petitioners are permitted to withdraw 50% of the award amount along with proportionate accrued interest and costs, deposited by the 1st respondent/appellant to the credit of MCOP No.6 of 2022 on the file of the Motor Accidents Claims Tribunal/Subordinate Judge, Melur, as per the order of the Tribunal by filing proper application.
