Prayer: This petition is filed under Section 151 of CPC to Vacate an Interim Stay granted by this Honourable Court in CMP(MD). No.13935 of 2023 in AS(MD). No.251 of 2023 dated 19.03.2025 and dismiss the above appeal suit and thus render justice.

This application has been filed to vacate an order of interim stay granted on 19.03.2025.

The interim stay order passed by this Court on 19.03.2025 is extracted

'' Notice to the unserved respondents returnable by 4.4.2025. Private notice is also permitted.

The appellant's counsel are at liberty to serve the papers on the learned counsel appearing for the unserved respondents in the final decree proceedings.

Subject to the condition that the appellant completes his service before the said date, interim stay of passing of final decree alone is granted''.

We only clarify that there is an order of interim stay passing of the final decree alone. Other proceedings other than passing the final decree may be proceeded by the trial Court.
