The Civil Miscellaneous Petition has been filed, seeking to condone the delay of 279 days in filing the appeal.

In the affidavit filed in support of this miscellaneous petition, it had

been contended that the copy application had been filed, but in the meanwhile, the petitioner fell sick due to jaundice and taking Siddha treatment at Nagercoil. Thereafter, funds have to be mobilized for payment of fees to the counsel. In all these procedures, there has been a delay.
