PRAYER – This Civil Miscellaneous Petition is filed under Order IV Rule 9(4) of the Appellate Side Rules to condone the delay of 120 days in representing the above A.S. SR.No.72607 of 2025.

We have heard the learned counsel for the petitioner. In the affidavit filed in support of the petition, it had been contended that the Petitioner was not able to contact his counsel and had also to make arrangements for the Court fees. He then suffered from Jaundice and his mobilisation of funds was restricted. In view of all these facts, the papers which have been returned by the Registry on 12.05.2025 had not been represented within time period.

2.Taking all factors into consideration, the delay of 111 days in representation is condoned.

3.Registry is directed to number the First Appeal if it is otherwise in
