This case came up for settlement before the National Lok Adalat. Appellant

and the respondent are present. The learned counsel appearing for the appellant M/s. B. Sureka and Mr. K. Myilsamy, the learned counsel appearing for the respondent is present. After mutual discussion, negotiation, mediation and conciliation between both parties, they arrived at a compromise to settle the matter as follows:

TERMS OF SETTLEMENT

Originally, the Trial Court has awarded a total sum of Rs.23,63,375/(Rupees Twenty Three Lakhs Sixty Three Thousand Three Hundred and Seventy Five only) to be payable to the respondents with cost and interest at the rate of 7.5% per annum as compensation. Aggrieved by the said award amount, the petitioner Insurance Company has preferred the above appeal.

Appellant and the first respondent are present and arrived at a settlement for a sum of Rs.15 lakhs with interest @ 7.5% p.a. From the date of petition till the date of deposit. The appellant agreed to deposit the said amount within a period of

6 weeks from the date of this order.

After negotiation, the award is as follows:

The parties have agreed for a sum of Rs.15,00,000/- (Rupees Fifteen

¶31

Lakhs only) with interest @ 7.5% p.a. from the date of petition till the date of deposit, less the amount already deposited.

(ii) The appellant is agreed to deposit the amount within a period of 6 (six) weeks from the date of this order.

(iii) The appellant / petitioner is at liberty to recover the award amount by the Trial Court.

With the above settlement, the Award is passed. Consequently, the connected miscellaneous petition is closed.
