JUDGMENT

This Civil Miscellaneous Appeal has been filed by the wife, being

aggrieved by the order passed by the Family Court in H.M.O.P.No.273 of 2023.

2. When the matter was taken up for consideration, a Joint Memo of

Compromise was filed by the parties, reporting settlement between them

¶19

and stating that they do not wish to pursue the appeal.

The terms of the agreement are as below:-

i The respondent / husband returned the gold articles and other personal belongings to the appellant / wife. As well as the appellant also returned the gold articles and other personal belongings to the respondent. Hereby, the appellant and the respondent confirm that they have no subsisting or future claim or right against each other in respect of any other article or belongings.

ii. The respondent / husband has not paid any maintenance to the appellant / wife. Also, the appellant hereby agrees not to claim any maintenance now or in the future.

iii. The appellant and the respondent would not raise any dispute for accepting all the conditions mentioned in this compromise memo after obtaining the decree of divorce.

iv. The appellant and respondent agree to withdraw all allegations against each other contained in the petition and counter in H.M.O.P.No.273 of 2023 on the file of Family Court at Cuddalore.

v. The appellant and respondent mutually agree to

C.M.A.No.1515 of 2025 dissolute the marriage solemnized between the appellant and the respondent dated 08.02.2021 at Kakkumkarai Vinayagar Koil, Kalasapakkam, Thiruvannamalai District which was registered as Marriage SI.No.TMR/Kalasapakkam/43/2021 dated 09.02.2021 before the Sub-Registrar Office, Kalasapakkam without anyone’s inducement or instigation.”

3. Recording the Joint Memo of Compromise, this Civil Miscellaneous Appeal stands disposed of in terms of compromise. The marriage solemnized between the appellant and the respondent on 08.02.2021 at Kalasapakkam, Thiruvannamalai, stands dissolved. No costs.
