JUDGMENT

The appellant is present in-person today.

The appeal is directed against the preliminary decree in a suit for partition, granting 1/4th share to the plaintiff.

Pending the appeal, the parties sat together and resolved all their differences. They have settled all issues between them, which has been reduced into writing as a Memorandum of Compromise, dated 11.12.2025. The parties to the appeal, have signed the said Memorandum of Compromise and the same is also witnessed by two persons.

The original Memorandum of Compromise is presented by the learned counsel for the parties, and it is prayed that the appeal may be disposed of in terms of Memorandum of Compromise, in and by which the parties have agreed to certain modalities of payment to be made by the appellant to the respondents, towards release of shares of the respondents.
