PRAYER : This Appeal Suit has been filed under section 96 read with under Order XI Rule 1 of Code of Civil Procedure to set aside the judgment and decree dated 31.08.2021 made in O.S.No.3588 of 2020 on the file of the V Additional City Civil Court, Chennai by allowing the appeal and dismiss the suit.

Challenge has been made to the decree and judgment of the trial Court directing the defendant to pay a sum of Rs.17,14,860 to the plaintiff with interest at the rate of 6% per annum from the date of judgment till the date of realization, in the present Appeal Suit.

When the matter is taken up today, the parties have filed a Joint Memo of compromise before this Court. The appellant appeared before this Court and the respondent appeared through video conferencing and submitted that the matter has been settled between the parties. It is submitted that the appellant has paid a sum of Rs.4,94,759/- [Rupees four lakhs ninety four thousand seven hundred and fifty nine only] by way of a Demand Draft bearing No.018828, drawn on State Bank of India dated 17.03.2025 as full and final settlement after deducting TDS, a sum of Rs.97,992 + 12537/- totalling a sum of Rs.1,10,529/- also hand over to the respondent. The Joint Memo of compromise has been recorded.

The respondent is permitted to withdraw a sum of Rs.5 lakhs with

cumulated interest which has been deposited to the credit of O.S.No.3588 of 2020 on the file of the V Additional City Civil Court, Chennai.

Accordingly, this Appeal Suit is disposed of in terms of the joint memo of compromise filed by the parties. No costs. The Joint Memo of compromise filed before this Court on 18.03.2025 shall form part of the decree. Consequently, connected miscellaneous petition is closed.
