balance outstanding commission charges with interest, the intending plaintiff seeks leave to sue the respondent before this Court.

In the draft plaint, it is stated that the plaintiff is a trader in pulses,

sugar and palm oil and doing services of procuring purchase orders for the said commodities from the wholesale traders in bulk quantities to those firms supplying to the Tamil Nadu Civil Supplies Corporation Limited (TNCSC). The defendant is the wholesale trader of those commodities. To engage the services of the plaintiff, the defendant has given the power to the plaintiff by executing Power of Attorney dated 05.12.2011. The defendant had also issued an offer letter dated 01.03.2015 agreeing to pay the charge for the prioritized services of the plaintiff. By a letter dated 02.05.2023 addressed to the Managing Director, TNCSC, the defendant authorised the plaintiff to attend, negotiate and finalise the rate for e-tender.

Upon examining the draft plaint and the affidavit in support of this application, it appears that at least a part of the cause of action arose within the jurisdiction of this Court. Therefore, this application is allowed by granting leave to the applicant to sue the respondent before this Court. Consequently, the Registry is directed to number the suit, if otherwise in order.
