O R D E R

The petitioner, who apprehends arrest at the hands of the

respondent police, for the alleged offences punishable under Sections 331(3), 319(2), 318(4), 204, 205, 118(1) of Bharatiya Nyaya Sanhita, 2023, (corresponding to Sections 454, 419, 420, 170,171, 324 of Indian Penal Code) in Crime No.83 of 2025 on the file of the respondent police, seeks anticipatory bail.

2.The case of the prosecution is that the petitioners herein along with the other accused impersonated themselves as the police officials, trespassed into the house of the defacto complainant and stolen 17 sovereign of gold jewels and also Rs.1,00,000/-. Some of the accused were arrested and released on bail and from them stolen articles were recovered.

3.The learned counsel appearing for the petitioners submitted that the petitioners are innocent persons and they have been falsely implicated in this case. He further submitted that based on the

confession statement given by the co-accused, the petitioners are arrayed as accused.

4.The learned Government Advocate (Crl.Side) submitted that the petitioners had accompanied the main accused persons and posed as police personnel and therefore, their custody is required for interrogation to ascertain whether they are involved in any similar offences

5.Considering the fact that these petitioners have been implicated

solely based on the information of the co-accused and their custody is not required, if they participate in the investigation and co-operate with the respondent police.

6.Accordingly, the petitioners are ordered to be released on bail in

¶31

the event of their arrest or on their appearance, on or before 04.09.2025

¶32

before the learned District Munsif-cum-Judicial Magistrate, Arcot,

on condition that each of the petitioners shall execute a bond for a

¶34

sum of Rs.25,000/-(Rupees Twenty Five Thousand only) with two

sureties, each for a likesum to the satisfaction of the learned Magistrate

¶39

concerned and on further conditions:

(a)If the petitioners fail to surrender before the concerned Magistrate on or before 04.09.2025, this order shall stand automatically cancelled;

¶41

(b)The sureties shall affix their photographs and left thumb impression in the application for surety ship (Judicial Form No.46 annexed to 'The Criminal Rules of Practice, 2019]'. The learned Magistrate shall obtain a copy of any one of identify proofs to ensure their identity;

(c)The petitioners shall report before the respondent police

daily at 10.30 a.m., until further orders;

¶44

(d)On breach of any of the aforesaid conditions, the learned Magistrate/Trial Court is entitled to take appropriate actions against the petitioners in accordance with law as if the conditions have been imposed and the petitioners released on bail by the learned Magistrate/Trial Court himself as laid down by the Hon'ble Supreme Court in P.K.Shaji v. State

(e)If the accused thereafter absconds, a fresh FIR can be registered
