Prayer: Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus directing the respondents to renew the Identity Cards of Licensed Porter (Sahayak) of the petitioners so as to enable the petitioners to carry on the occupation of the Licensed Porters in the Chennai Central Railway Station, Park Town, Chennai-600 003 by considering and passing necessary orders on the representation of the petitioners dated 27.1.2024.

Manohar, learned Senior Central Government Standing Counsel accepts notice for the respondents, being officials of the Southern Railway, and is armed with instructions to enable final disposal of this Writ Petition, even at the stage of admission.

The prayer of the petitioners, numbering 48, is for disposal of their representation dated 27.01.2024, wherein they have requested the respondents to renew the identity cards of licensed Porters to enable them to carry on their business in the Chennai Central Railway Station, Park

This Court has nothing to say in regard to the request concerning issuance of identity cards as that would involve assimilation of various facts, which cannot be done in a Writ Petition and it is for the respondents to satisfy themselves that the factual assertions made are correct.

However, learned counsel for the petitioners would restrict the scope of the Writ Petition for consideration of the representation alone. Mr.Subramaniyam, learned counsel for the respondents would accede to the receipt of representation dated 27.01.2024 in light of the seal of receipt affixed at page 10 of the representation (seal of the office of the Divisional Railway Manager dated 29.01.2024 – placed at page 129 of the typed set).

In light of the aforesaid, mandamus is issued to R2 to consider

the representation of the petitioners and dispose the same in accordance with law, after hearing them, within a period of eight (8) weeks from date of receipt of a copy of this order.

This Writ Petition is disposed as above. No costs.
