Prayer: Petition filed under Article 226 of the Constitution of India seeking a writ of Declaration declaring Notification No.82/(RE-2008)/ 2004-2009 dated 23.01.09 issued by the second respondent from F.No.01/89/180/0053/AM01/PC-2(A) insofar as it prohibits import of Toys from China classifiable under ITC Code 9501, 9502, 9503 of Schedule I of ITC (Health Secretary) Classification of Import and Export Items for a period of six months from the aforesaid date as illegal, arbitrary, unconstitutional, without jurisdiction and in violation of the rights guaranteed under the Constitution of India.
