PRAYER:- The Transfer Civil Miscellaneous Petitions filed under Section 24 of the Code of Civil Procedure to withdraw the Suit in O.S. No.288 of 2023 and 416 of 2023 respectively pending on the file of Additional District Court, Namakkal and transfer the same to the file of District Court, Salem.

The petitions have been filed seeking to withdraw the Suits in O.S. No.288 of 2023 and 416 of 2023 respectively on the file of Additional District Court, Namakkal and transfer the same to the file of District Court, Salem

Heard Mr.K. Selvaraj, learned counsel appearing for the

petitioner.

The present applications are for transfer of Suits in O.S. No.288

of 2023 and 416 of 2023 from the file of Additional District Court,

Namakkal to the file of District Court, Salem.

¶63

Two other Suits are already pending. The third Suit of the same subject matter in O.S. No.66 of 2015 was filed and the learned counsel for the petitioner submits that the said Suit was dismissed on 07.12.2021. Subsequently, another tenant had filed a Suit in O.S. No.416 of 2023,

which is pending on the file of the Additional District Court at 3/6

Namakkal. The petitioner seeks transfer on the ground that he is 82 years old and suffering from several ailments. If I transfer the Suits from the file of Additional District Court, Namakkal to the file of District Court, Salem, it would only result in further delay and increase agony to the petitioner.

Therefore, the option that I would choose is to give direction to the Additional District Court at Namakkal to dispose of the Suits in O.S. No.288 of 2023 and O.S. No.416 of 2023 within a period of four (4) months from the date of receipt of copy of this order and submit a report to this Court. The said period of 4 months shall not include the ensuing summer vacation in May 2024. The learned Additional District Judge is requested to take into consideration the advance age of the petitioner and dispose of the Suit without granting any unnecessary adjourments to the parties.

With the above direction, both the Transfer Civil Miscellaneous

Petitions are dismissed. Consequently, connected miscellaneous petitions are closed.
