PRAYER : Second Appeal filed under Section 100 of the Civil Procedure Code, to set aside the decree and judgment, dated 04.03.2004 passed in A.S.No.127 of 2003 by the Sub Court, Sankarankoil, confirming the decree and judgment, dated 15.10.2003 passed by the Principal District Munsif Court, Sankarankoil in O.S.No.192 of 2000 decreeing the suit filed by the respondent / plaintiff and allow the appeal of the appellant / defendant with costs.

JUDGMENT
Mr.Ramesh @ Ramiah, learned Counsel for the appellant
appearing through Video Conferencing submits that the first appellant, Krishnan is no more and his son Marimuthu is already on record. He further submitted that he has not received any instruction from the surviving second appellant and hence, reporting 'No instruction'.
2. The learned Counsel for the respondent is present.
3. Recording the statement made by the learned Counsel for the
appellant, this Second Appeal stands dismissed for default. There shall be no order as to costs.
