For Anticipatory Bail in Crime No.104/2024 on the file of the respondent Police.

ORDER : The Court made the following order :-

The petitioner, apprehending arrest at the hands of the respondent Police, in connection with a case in Crime No.104 of 2024, for the offence punishable under Sections 147, 148, 452, 294(b), 323, 324, 307 and 506(ii) IPC and Section 4 of TNPHW Act, has filed this petition seeking anticipatory bail.

The case of the prosecution is that the petitioner and the defacto complainant are husband and wife. The petitioner is having illegal affair with another person. When the defacto complainant has questioned the same, the petitioner along with the other accused has abused him using filthy language, assaulted him using sickle and caused injury. Hence, the case.

3.This is the third application filed by the petitioner seeking the very same relief. Considering the nature of offence, the earlier applications were dismissed by this Court.

4.In the earlier occasion, when the present petition was taken up for hearing, the learned Counsel for the petitioner submitted that the petitioner is ready to contribute a sum of Rs.50,000/- to the Rotary Midtown Community Trust, Madurai,

for providing purified drinking water to the students, who are studying in the Corporation Study Centre.

5.Today, it is represented that a sum of Rs.50,000/- has been paid to Student Study Circle, Gandhi Museum. To that effect, the learned Counsel for the petitioner has produced the receipts.

6.Considering this change in attitude, this Court is inclined to grant anticipatory bail to the petitioner.

Accordingly, this Criminal Original Petition is ordered and the petitioner is ordered to be released on bail in the event of her arrest or on her appearance within a period of fifteen days from the date of receipt of a copy of this order, before the concerned learned Judicial Magistrate on condition that

(i) the petitioner shall execute a bond for a sum of Rs.25,000/-(Rupees Twenty Five Thousand), with two sureties each for a like sum to the satisfaction of the learned Judicial Magistrate, Thiruchuli, Viruthunagar District.

(ii) The petitioner and the sureties shall submit a copy of their Aadhaar Card or any other identity card issued by the government in proof of their residence address;

(iii) The petitioner shall appear before the respondent police as and when required for interrogation. She has to co-operate for the investigation.

any further offence and shall not tamper with the prosecution witnesses.

(v) On violation of any of the above conditions by the petitioner, the respondent

police shall move an application for cancellation of the anticipatory bail.
